General Consent Worries (page 1 of 3) (i.e. not about payment)
• Risk of unforeseen or unpredictable psychological or emotional harm, particularly that caused by having to ‘give up’ the baby; plus the possibility, or likelihood, of regret
• Changes of perspective caused by childbirth and pregnancy
• Direct experiential knowledge is needed to adequately understand
certain things: e.g. childbirth, pregnancy, ‘giving up’ a baby
• Women’s altruism (directed or otherwise), family relationships, or enjoyment of being pregnant could be taken advantage of
General Consent Worries (page 2 of 3) (i.e. not about payment)
• Risk of unforeseen or unpredictable psycho‐emotional harm
– Is it really unpredictable? Information at least of a statistical
kind is possible, alongside explanatory case studies
– The possibility of regret isn’t obviously sufficient to invalidate consent (although it may underpin a paternalistic argument against surrogacy)
• Changes of perspective caused by childbirth and pregnancy
– This could be a matter of forcefully warning potential surrogates that they may feel differently having been through childbirth and pregnancy
