UK Law ‐ overview
• Surrogacy Arrangements Act 1985
• HFE Act 1990 /2008
• Surrogacy permitted but discouraged
• ‘Commercial’ aspects are criminal
• Payments between IPs and S not illegal
• But agreements are unenforceable
• No commercial agencies/advertising
• No brokerage of arrangements for money
• Surrogate is the legal mother (and her spouse/partner 2nd parent)
• Biological father can sometimes be legal father (if S unmarried)
• IPs can obtain a ‘parental order’ to transfer legal parenthood
• But tight rules and not everyone eligible
